These Terms of Service ("Terms") govern your use of TourPulse (the "Service") at tourpulse.ai, operated by Bertwell Holdings LLC ("TourPulse," "we," "us"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

2. What TourPulse is

TourPulse tracks secondary-market concert ticket prices and provides timing-related recommendations (e.g., Buy / Wait / No Rush / consider an alternative date) and estimated price information. TourPulse is an informational tool. We do not sell tickets, and we are not a party to any ticket transaction.

3. Accounts

You can sign in using a one-time link sent to your email ("magic link"). You are responsible for maintaining access to your email account and for activity under your account. Notify us at support@tourpulse.ai of any unauthorized use. You agree to provide accurate information.

4. The recommendations — important disclaimer

Informational and probabilistic only. Our labels, scores, forecasts, and "estimated savings" are predictions based on historical and current data. They are not guarantees and may be wrong.
Not financial, investment, or professional advice. You are solely responsible for your purchasing decisions.
Prices and availability come from third parties and change constantly. We do not control, and do not guarantee the accuracy of, third-party pricing, availability, routing, or event information.

5. Third-party marketplaces and tickets

Cancellation. You may cancel anytime from your account; cancellation takes effect at the end of the current billing period.
Refunds. Watch Pass purchases are non-refundable once the pass is active. Subscriptions can be cancelled at any time and are not prorated.
Changes. We may change prices prospectively with notice.

9. Intellectual property

The Service, including our software, model outputs, text, design, and branding, is owned by Bertwell Holdings LLC or our licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. Underlying event and pricing data may be owned by third parties; nothing here transfers rights in that data to you.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOURPULSE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM TICKET PURCHASES, MISSED PURCHASES, OR PRICE CHANGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID US IN THE PRIOR 12 MONTHS OR $100.

12. Indemnification

You agree to indemnify and hold harmless Bertwell Holdings LLC from claims arising out of your misuse of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time.

14. Changes to these Terms

We may update these Terms. We will post the updated version with a new "Last updated" date and, where required, provide additional notice. Continued use after changes means you accept them.

15. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. You and TourPulse agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to the personal jurisdiction of those courts.
